COURT WIN IN MA!! laserd doing 75 at a 55 from 850 feet. I need help getting an unfair ticket dismissed. I know for a fact I wasn’t doing the speed he claimed he clocked me doing. I was being overtaken by another vehicle from my right at the time he clocked my speed using a laser gun.
He wrote on the ticket that he got me at 75 MPH from 850 feet. This was late at night on a highway curve and he was hiding at the bottom of a small hill. I spotted him as soon as I was on top of the hill. I think he was about 800-900 feet away on the right emergency lane when I made the visual on him and my radar detector went off immediately. For once I didn’t slam on the brakes since I was only doing 5 MPH over the posted 55MPH. Now, at that same exact moment, there was another vehicle that pased me from my right and it looked like it was doing about 75-80MPH. I felt sorry for that car since I thought he just got owned and I was picking up laser from his car being aimed at. Few moments later I see the blue lights behind me and I move to the right lane as I thought the trooper in his cruiser just wanted me to clear the road so he can go after the speeding vehicle. But noooo, to my surprise the blue lights stayed right behind me and moved to the right lane with me!!! I pulled over and immediately explained to the officer how he made an honest mistake in pulling over the wrong car. He insisted that he was aiming at my car and that he’s confident he clocked me doing 75MPH according to his laser gun. I was furious but kept my calm and tried to explain to him that I was being overtaken from my right when he was trying to get a reading on my vehicle. The officer wouldn’t budge on his decision. He goes back to his cruiser and comes back with the citation!!
My theory is that the state trooper was waiting under the hill aiming his laser gun on the fast left lane and just waiting for vehicles, and while aiming at my car he got a reading on the vehicle that was passing me from my right. Even worse, I think he was lazy and only aiming\focusing at the left lane a.k.a fast lane, this way he'll ensure to get a quick reading on incoming vehicles since he was parked close to where he could get a visual on incoming traffic.
So far, I’m planning on taking pictures of the place it happened to show the cop had no visual over 900 feet. This should prove he couldn’t visually tell if I was actually speeding beyond the top of the hill other than the fact he was waiting for cars to appear on top of the hill then lasering them with his gun. I’m hopping the judge would believe the fact that another vehicle was passing me at the moment the officer was getting my vehicles speed.
I have a court date before a judge next week and I need help in producing the right documents to prove this in court. You’re help will be greatly appreciated. |
