I'd pay the extra money to have it towed from the dealer it's currently at, to another repair place, not owned by the same copmpany that owns the dealership that told you it ran out of oil.

Also, I wouldn't say too much to the current dealer, as they might place a comment in the computer system that would make warranty repair difficult at another dealer, if that's still available to you.

The symptoms you describe don't sound like an out of oil situation to me, but do sound like a try and maximize the repair bill ploy.
