    Default Advice Request; Son got ticket in VA, lives in NC

    Doing 85 in 65 in VA, on his way to see his life long buddy (Dachshund) who had been in a life threatening accident.

    Told him to plead guilty, pay the fine and consider himself lucky.

    Question is; Does either state offer any "classes" to minimize impact of "points" on his record/insurance rating?

    Would he have to take it in VA or NC?

    He's always laughed about my V1 and Blinders....Guess he's not laughing now.

    He does not need to be paying that fine. He needs to be paying for a lawyer. He's facing possible jail time for that. Virginia is filled with a bunch of nazis that will throw you in prison the second they have the chance.

    Isn't anything above 80mph in VA considered reckless driving---and therefore, by default, a Class 1 misdemeanor? Mandatory court appearance if I'm not wrong.

    Anything over 80 is reckless driving and will be reported to NC as such. NC will suspend his license on a guilty plea for at least 30 days!!! Time to lawyer up!!

    ^Agree, if your son has a NC license (I assume he does) he will definitely need to lawyer up. NC (in their infinite wisdom) views out of state tickets the same as if you got them inside the state of NC. I don't agree w/this crap but it is what it is.

    NO !!!! don't just pay the fine. It's is a misdemeanor that will be on his record and if he wants to get into Grad schools, certain jobs, etc. it can make that process harder. Get a lawyer and fight it so at least you don't get a criminal record from a dumb speeding ticket.

    Your son needs to lawyer up. Anything in Virginia above 80 mph is reckless driving, a first class misdemeanor.

    I am a NJ resident, caught a reckless driving charge for doing the same thing in Fairfax County several years ago. 30 day jail sentence (suspended), 1 year of inactive probation, VA driving privileges suspended for 30 days, $300 in fines and court costs.
    Lawyer warned me that VA loves to prosecute reckless driving cases - sometimes judges will throw a soccer mom in jail for a weekend to teach them a lesson. NJ MVC never found out about this conviction.

    If your son has a clean driving record, hopefully the lawyer can negotiate it down to 79 in a 65, avoiding the reckless charge. Since there is threat of jail time, he must appear in court, he cannot just mail in the fine. Because of the threat of incarceration, again, he should lawyer up.
