I'm not sure which dept you work for, or which courts you appear in, but I can tell you that I've had an opportunity to observe many CMVI appeals in Barnstable and Orleans District, and there are some judges who will most definitely listen to a well thought out presentation by a defendant, even if it's "technical", so don't get too cocky about it "never working"! Also, if you're in the habit of ignoring legitimate requests under the state FOIA law, it's only a matter of time before some paid mouthpiece is going to make you look bad in court (or, even worse, a pro se defendant).
OTOH there are judges who really don't give a crap what the defendant is saying, too, and just take the cop's word at face value; probably more of those, as I think of it.
