Default COURT WIN IN MA!! laserd doing 75 at a 55 from 850 feet.

I need help getting an unfair ticket dismissed. I know for a fact I wasn’t doing the speed he claimed he clocked me doing. I was being overtaken by another vehicle from my right at the time he clocked my speed using a laser gun.

He wrote on the ticket that he got me at 75 MPH from 850 feet. This was late at night on a highway curve and he was hiding at the bottom of a small hill. I spotted him as soon as I was on top of the hill. I think he was about 800-900 feet away on the right emergency lane when I made the visual on him and my radar detector went off immediately. For once I didn’t slam on the brakes since I was only doing 5 MPH over the posted 55MPH. Now, at that same exact moment, there was another vehicle that pased me from my right and it looked like it was doing about 75-80MPH. I felt sorry for that car since I thought he just got owned and I was picking up laser from his car being aimed at. Few moments later I see the blue lights behind me and I move to the right lane as I thought the trooper in his cruiser just wanted me to clear the road so he can go after the speeding vehicle. But noooo, to my surprise the blue lights stayed right behind me and moved to the right lane with me!!! I pulled over and immediately explained to the officer how he made an honest mistake in pulling over the wrong car. He insisted that he was aiming at my car and that he’s confident he clocked me doing 75MPH according to his laser gun. I was furious but kept my calm and tried to explain to him that I was being overtaken from my right when he was trying to get a reading on my vehicle. The officer wouldn’t budge on his decision. He goes back to his cruiser and comes back with the citation!!

My theory is that the state trooper was waiting under the hill aiming his laser gun on the fast left lane and just waiting for vehicles, and while aiming at my car he got a reading on the vehicle that was passing me from my right. Even worse, I think he was lazy and only aiming\focusing at the left lane a.k.a fast lane, this way he'll ensure to get a quick reading on incoming vehicles since he was parked close to where he could get a visual on incoming traffic.

So far, I’m planning on taking pictures of the place it happened to show the cop had no visual over 900 feet. This should prove he couldn’t visually tell if I was actually speeding beyond the top of the hill other than the fact he was waiting for cars to appear on top of the hill then lasering them with his gun. I’m hopping the judge would believe the fact that another vehicle was passing me at the moment the officer was getting my vehicles speed.

I have a court date before a judge next week and I need help in producing the right documents to prove this in court. You’re help will be greatly appreciated.

Thanks for everyone that shimmed in with advice :roll: !! I guess either I got all my basis covered or I have no chance of beating this ticket…lol


I do have other questions to all the knowledgeable forum members to add as I’m preparing my defense.

* How do I obtain what Lidar gun was used? Is it only through discovery? I might not have time since its next week?

* I’m I still eligible to file for a continuance?

Again.. ur input will be greatly appreciated!!

Both! I need help and ur being slow!!! lol. But seriously, I’m getting nervous and anxious as the court date nears (less than a week). And feeling under-prepared is not helping.

BTW Suff, I read a lot of ur posts and would like to personally thank you for your great contribution to this forum. I have recently joined the NMA organization and I’m coming to this forum to be sure I covered all my basis. I’m sure I can use few pointers here and there from everyone who went through these court experiences!!

I know that feeling benz ...check through this entire section of the forum. There is alot of previous posts about court cases to give you ideas of what you can do. :idea:

Laser guns are dead accurate. You were definately doing that speed unless the officer targetted another car to get that reading and then lied saying it was you. Are you saying the officer is lying?

Why not just pay the ticket and be more careful next time?

Focus on not getting caught but realize it's still possible.

So you're basically saying I don't stand a chance in getting this ticket dismissed? even thought I'm 100% sure I know I wasn't going 75 and know for sure it was the vehicle that overtook me from my right triggered the higher reading???

I wouldn't mind paying the fine if I knew I was going that fast and avoid wasting my time all together from my already busy schedule. However, I'm determined to do whatever it takes to get this fictitious ticket dismissed and away from my record given the fact I know I wasn’t going as fast as claimed.

I’m not going to BS everyone here. I do go over the speed limit every now and then but strictly and only on highways with multiple lanes and I’ve been good at not getting caught for the past 6 years. But If I’m going to get caught speeding then I better get caught when I’m actually speeding.

With that being said, I just recently bought an escort 9500i and installed the blinder…. Hopefully that will keep me away in the future from trouble whether I’m going over the speed limit or not!! And surely can’t wait for the LI to be released as I’m planning to install it in my vehicle and install the blinder on my 07 R1.

I had my court date before a Judge yesterday. I have never seen this before but the judge couldn't make a decision on the spot. She said they will send me a decision in the mail??

Anyone had a similar outcome?? What should I expect in the mail?? I was able to demonstrate very well how the officer tagged another vehicle and not mine. The judge seemed pretty convinced but couldn't make a decision.

I know this is kinnda late, but maybe what happened, is he went for your passneger headlight, panned around, and hit the other car? Maybe he assumed since you were in the fast lane you were the one going fast?

BTW, when you got hit with the laser, did the other car slow down? Or did he keep on going the same speed? Just curious.
