Default Thanks to Suf Daddy! Got out of my NH 81 in a 55 ticket!

I had absolutely no idea what to do when I started out on this...Suf Daddy's help was the ONLY reason I got out of it. He told me to motion for a continuance and subpeona for assorted items. He had a comprehensive list and process for me to follow, but I left some of the items OFF of the discovery list.

I felt that some of the items were "too prodding" and if asked about them in court, I wouldn't have the expertise to use them to my advantage. When I told Suf Daddy that I left a few (key) items off, he told me to motion for a 2nd continuance and to ask for them in discovery otherwise he could guarantee I'd lose!

The items I didn't ask for were: lidar unit to be present in court, copy of the user's manual, and the person who calibrated the lidar unit to be present in court. I asked for these on my 2nd motion for continuance, however, to my dismay, the continuance was denied.

I became nervous because Suf Daddy had predicted that I'd lose if those items weren't present in court. He said asking for these items would almost ensure a no-show for the officer because they would know a tough battle was ahead of them if the defendant was asking for such items.

I showed up this morning to court, after I had spent many hours reading the 10+ PM's Suf Daddy had sent me - tips and links on how to fight the ticket. I felt I was prepared but at the same time still very nervous going up against the man.

When I was called forward, the state appointed officer said there was no prosecution. Apparently, the officer who pulled me over was expecting my 2nd continuance to be granted - when it was denied, it ended up not fitting his schedule! My charges were dropped and I was sent home free!!!!!!!!!

I'm willing to bet the guy had already decided not to show when he saw what items I subpeoned with my 2nd continuance - the judge even raised a brow as to why the officer couldn't show. He questioned the state appointed officer as to his reasoning, but all she said was that it didn't fit his schedule and he was planning on another continuance.

This was all thanks to Suf Daddy! He is a GREAT resource and extremely helpful person. Can't thank him enough for the guidance in this process.

Now I just have to figure out something for my 2nd ticket hearing - 95 in a 55

Jesus christ man, congrats on the no show win, but you gotta slow down. What countermeasure do you have?

There's no excuse but a 350 whp Evo doesn't help ops: I just need to sign up for track days instead of using that power on the street.

I'm a fish out of the water on this 2nd one...I've already been found guilty at the magistrate hearing and I didn't go through a discovery process on this one - a lawyer that I talked to just recommended that I should just try some sort of negotiation w/ prosecution.

I've PM'd Suf Daddy on his thoughts though

Hot dam, a EVO, well that explains it, yeah, at that point although very tempting to do otherwise, it would be much better as well as enjoyment to let it fly on a nice track. Good luck, and get some countermeasure for god sakes.

The police and courts hold a high standard than the civilian is held to.

There are proceedures and training involved for many reasons.

There are serious radar and LIDAR issues as the technologies aren't as fool proof as the public is lead to believe.

I find it very disappointing that most of the time you get lied to.

Its shouldn't be an us vs. them mentality, who do you call when your in trouble?

But with these "infalible" laser guns, with three beam laser diodes, being used far beyond the 1997 NJ Superior court ruling (LTI Laser guns where on trial then......since reinstated around 1998) of 1,000 feet, there will be WRONG SPEEDS calculated and problems.

Until the mentality of a 70 and 85 MPH being equal.......................
"Everyone's speeding, so the fine really doesn't matter" is cleared and the
usual ticket is now written for 15MPH and above (I wonder why) issues will remain.

Writing a 20 plus MPH over ticket isn't going to make it "Stick".
Its going to polarize people into looking harder at the speed detection methods.

I've been tagged for 70 in a 50 when I was between 50 - 55. I WATCHED THE GUY take my reading after he let the last one go. HE was obviously visible to me and I wasn't speeding. HE pulled me over for 70MPH and no front plate.........(the real reason I feel) then he charged me $50 extra on the schedule fee.

He said I could talk about it in court: and placed the burden on me.
Nearly impossible to defend against a secret technology; "infalible" is was told....................... :roll:

Now look whose getting the truth out..........
No more easy money.

I fault bad training, bravado and being lazy (NOT FOLLOWING PROCEEDURES) as the root of most of the rogue tickets.

But until the systems fixed and the technology ACTUALLY works like LEOs are TOLD it does............we'll have to continue the uphill climb or guilty before prooving our innocence.

We all need to hold ourselves to a higher standard.

That also means not doing 30 plus over the limits..................
