Howdy ya'll. I am new to the forum and I am really hoping to leverage the collective knowledge here to beat a LIDAR ticket just outside of San Francisco.
I was coming out of heavy fog over the Karkanis Bridge coming into Hercules and I was being tailgated in the inside lane by a car 1-2 seconds behind me, a car was directly to my right in the slow lane, and I had another car in the slow lane about one car length in front of me to the right also. As we came out of the fog and started down the hill into clearly light sunlight, all the cars started to accelerate. I tried to put a safe distance between myself and the car tailgating me by moving from the speed limit of 70 to 85mph. The car behind me was still within 2 seconds behind me as I saw a CHP officer to the right side of the roadway perhaps .25 miles ahead of us. I had no choice but to maintain speed with all the cars surrounding me and we all passed the officer as he engaged in pursuit. The officer ended up recklessly weaving through the several cars that were behind the pack surrounding me, cut around the car the was tailgating me up until he noticed the officer enroute, and for some reason the officer chose to pull me over. He informed me that he had clocked me with radar at 87mph. I mentioned the guy tailgating me and the other car that was in the right front of me and asked him if he was sure he had actually calculated my speed out of the pack of cars he swerved through. He persisted to tell me that he was certain and he issued me the ticket. My wife and the two 16 yr old kids in the car could not believe his story either as they had witnessed the car formation around me prior to being pulled over.
I personally believe this cop chose me because he was able to see my radar detector in my windshield. This is not right and I have 1.5 months to come up with an incourt defense. Any ideas would be welcomed.......
