I recently got a speeding ticket for 115 MPH in a 60 zone. Not sure I was doing this speed. I don't have the cop report yet saying what distance he caught me but I am going on the guess that it will be no more than 800 feet since there is a curb at that distance. I know he has either an Ultralyte LTi 20/20 or Marksman
He was perpendicular to the highway about 10 feet from the shoulder and shooting from his car, window down, no tripod through bulrushes or weeds a few feet from his car window on a windy day.
I have a black R8 Spyder and top was down on a nice sunny day. My intention is to fight it and I have read up quite a bit on lasers and possible defence. I have talked to two acquaintances who are police officers who do laser, and after having talked to me, became aware that their knowledge is really very limited and inaccurate and I should assume the same from the cop who zapped me, so that his testimony on the stand will be what the judge takes as expert testimony.
However, since I can't find an expert witness in the Montreal area, I will have to use arguments that are common knowledge and allow that the judge will in most cases go with what the police officer believes are the way a laser functions. I will use a lawyer, but lawyers know laws and have limited knowledge of lasers, so I need to help out.
HERE ARE SOME OF MY POSSIBLE DEFENCES SO FAR:
INTERFERENCE: Originally I thought the fact that he shot me through some bulrushes was a good defence since the Ultralyte 20/20 manual says that he should have no interference. However, my cop acquaintance said it doesn't matter since he got a reading, it means there was no interference....comments
MORE INTERFERENCE: Coming out of the curb, 800 ft from cop was a large sign indicating next exit. On the right of me was a guard rail all along. I was also passing two other cars. I know it can all be interference as light could have gone from me to guard rail and another car etc.
When I told my cop acquaintance, he said that's not possible since he would have got an error reading etc. Whether it is true or not, if the cop who zapped me says the same thing, how can I argue differently, since he is an expert.
PAN & SWEEP: After reading up on this I know it is possible to get the windshield and then with a slight jerk possible hit the lights or hit the side of the car and move forward towards the front and hit the headlights (I have no plates).
However, when I said this to the cop acquaintance who does laser, he said it doesn't matter, light comes back at the same speed which everyone knows, but if there was a reading, then it was correct.
Would there be an error message if he started up on the windshield and moved to lights or slid across back of car to front?
ALIGNMENT: I know this is an issue that at 115 MPH. If I was doing that speed then I was d close to 170 feet a second, and coming in from an angle, so it is difficult to align.
This means that at 800 feet he had about 4.5 sec to zap me as I came out of the curb. Is that enough time?
I can't make any solid evidence from this other than to create a small doubt.
GOING UPHILL: When the cop zapped me, I was going uphill and he us higher up. Does this affect a reading?
If so could you explain please.
TESTING GUN, BEFORE AND AFTER: cop acquaintance told me that less than 1% of cops actually do the required tests before or after and this was my best defence. From a good friend of towing company familiar with highway cop hours, I know Cop started his shift at 3 pm and zapped me 3:40.
How long does it take to do all the required tests?
FRAGILE LASER GUN: I know the instruction manual says the guns are fragile and should also be placed in original container or capped to prevent damage. I saw the cop left his gun on the tablet in the cop car. Is there any worthwhile defence with this.
