Default VA - VA Drivers Get Ready to Bend Over (yes, even farther)

VA Drivers, time to stock up on some KY at the local CVS because the Commonwealth is about to stick it to you again.

Every July 1 is when many VA laws go into effect. This often means new ways for VA drivers - and non-VA drivers travelling through the state - to get screwed even more than they could the previous year. This year is no exception. In fact, it's a bonanza - especially for VA drivers.

Now it makes sense why - as reported in the V1 forum - the VSP has been quietly contracting to order a boatload of radar detector detectors.

    http://www.washingtonpost.com/wp-dyn...062201781.html

All the non VA drivers passing thru VA will now make a point to speed 20+ in order to piss off all the VA drivers they will be passing.

Wait, you're allowed to use a detector in VA if your license is from a different state?

No, but IMHO someone should argue that and challenge it in court.

Case and point. Let's say you have a ZR3 or similar product installed. How are you supposed to comply with the VA law? You can't. Not unless you pull over when you enter the state and disconnect it from your battery connection. That would obviously create a hazard for yourself and other motorists.

This would be akin to requiring Maryland drivers to remove their 35% front window tint (legal in MD, illegal in VA) upon entering the state.

On the other hand, perhaps VA should use the tax $ they generate from their stupid ass and unconstitutional laws to build some rest stops just over the state border for this purpose.

Maybe with all these new BS laws coming into effect, perhaps someone will finally grow the balls to fight this crap in court. Personally, I'd like to see the NMA or a similar organization step in and assist.

This garbage needs to be overturned. Keep in mind, these are payed yearly for 3 years and are ON TOP of the fines assessed by the courts(double tax anyone?). Also, if you have more than 8 points on your DMV record you pay $100+$75 per year for 3 years (simply going 10mph over the speed limit is 4 points, 20+ 6 points). Rack up two 10-19 over the PSL and they will be comming for you.

Also, RD-general is one of those on there and for those who don't know a cop can write an RD-general for ANY moving violation(this would incur 3 yearly payments of $350).

Good thing my company has an office in Maryland..........i've already put in a transfer request .
Oh, and you think you've heard enough BS about this law, it gets even better. One of the co-patrons and big supporters of this bill (David Albo), also happens to be an attorney and senior partner at a law firm here in VA. Taken from his bio:

Practice Areas: Criminal and Serious Traffic Law, Constitutional Law; Civil Litigation; Labor and Employment Law; Discrimination

makes you wonder who is really benefitting from this new law

No, I don't believe that is quite true but you are close. First off, the extra super special point fines kick in at over 8. That being said, it takes 3 years for most of the state violations to scroll off your DMV record, so you could get schtuck with those fines for 3 YEARS even if you don't accrue any more I.O.U.'s from the local Po-lease.

However, to your point there are 13 (yes THIRTEEN) different RD violations on the f-ing statute.

Even if you just look at the +20 over PSL part of the RD statute, it was written in 1950 (that's 57 years ago people). The PSL in VA was... who knows, I was not even born then. But mom and pop were not driving mini vans which could easily go over 80 without trying. Today is a whole different story.

Imagine you are speeding only 10+ PSL on parts of I-85 in western part of VA - bam. A nice F.U. from the state. That will be your fine + $350 a year for 3 years + btw you owe property taxes every year on your ride too.

Did you read the quote by Davis (attorney) in the Post article, where he basically said he's looking forward to more $ as a result of all the peeps who will appeal up the arse?

The lawyers will have a field day. Maybe time for me to goto law school and change professions.

Nearly all the state legislators are lawyers, especially the ones in Northern VA, which is where you have the most horrendous traffic in the universe and the tallest pile of political BS per square mile.

The next beneficiaries will be all the home loan specialists writing home equity loan policies so that ordinary people can afford to pay their new taxes.

This is off topic, but another reason not to live in VA.... your kids cannot touch each other AT ALL in school... check out this lunatic asylum of a state:

I hope these a-holes' property values suffer due to all the peeps who now move out of the state.

Reminds me of something I read 5 or 10 years back about how Americans kids are developing a tendency to avoid the physical contact with each other that is natural among other cultures, such as Europeans...can't remember what the point was, like why the researcher thought it was happening. But if schools start enforcing this kind of bull****, I guess we'll all know why!

Agreed. now think about the fact that 1) this is the same state that just had the VA Tech shootings, and 2) the gunman was from Northern VA (town of Vienna - subject of the article - is in NoVA).

    Hmm.... a connection????

Get me if I'm wrong here, but there is a serious difference here between what out of state drivers have to pay and what in state drivers have to pay. Many hundreds of dollars ...

Isn't that just going to give out of state drivers to a license to speed in Virginia??? Why pull them over for going 90 when i can charge someone in state going 78 ten times as much.
