State Supreme Court says Fargo cannot set higher fines

(Paul Jurgens, KFGO, Fargo) FARGO, N.D. (AP) District court judges have said it and now the North Dakota Supreme Court agrees.

The high court says Fargo and other North Dakota cities don't have the power to charge more for speeding fines than allowed by state law.

The court's opinion is part of a federal lawsuit against Fargo.

It was filed by Stephanie Sauby, who complained Fargo's fines for traffic violations were too high. She's asking to have the case declared a class action lawsuit, which could benefit any driver who paid a Fargo traffic fine since August 2001.

The city attorney says some changes will have to be made to Fargo's speeding fine laws until case is finally resolved.

Two years ago, Fargo police issued more than 19,000 citations for all traffic offenses. That brought the city almost two-and-a-half million dollars.
