Speed cases struck out following High Court ruling
Monday's landmark High Court ruling which found Garda laser guns to be in breach of the provisions of the Road Traffic Act 2002 came into play on Tuesday as Judge Donnchadh ”Buachalla struck out six speeding cases at Wicklow District Court.
Mr. Justice Quirke had ruled the day before in the High Court that the laser guns were flawed as they didn't provide a written or permanent record of the speed cars were travelling.
All but one of the charges struck out by Judge ” Buachalla related to travelling at speeds exceeding the legal limit at Mountkennedy Demense, Newtownmountkennedy in 2004.
The struck out proceedings were against Eoin Devlin, 152 Rosehill, Wicklow town for speeding on June 2; Graham Dowling, 38 Walnut Close, Kingswood, Dublin 24 for speeding on August 4; Stephen Murray, 30A Soldiers Road, Bray for speeding on June 3; Louise Knatchbull, 1 Westview Terrace, Bray on July 30 and Pat Mannion, 38 Eden Grove, Donabate for speeding on May 17.
Proceedings against Gerard Nicholl, Kilnamanagh More, Glenealy for speeding at Ballyfree, Glenealy on June 6 were also struck out.
