Cool Re: Officer nails guy for speeding costs him 1mill dollars

I second that motion CJR. My question to the guy is, "If you knew you had weed in the glovebox, Why oh why would you concent to a search? Isn't that the first place they ALWAYS look?"

The expression on the officers face is pretty funny when you refuse to let them search your car. I have had them request a search a few times.

I just tell them it would be a waist of there time and mine.

^^ If you say no and they really want to search it they just call the K-9. Not that I would know personally...

They do it on "COPS" all the time

Yes but that's the trick, the officer is stuck in a dilemma. If he's wrong he's screwed, plus he cant call in a dog to search your car without your permission ether. The "COPS" actually called in a dog and search the car without the drivers permission?
The key when telling the officer no is to make him believe you have nothing and its not a big deal to you, just a waist of both your time.

I would tell him to go ahead and get the K-9, get the video camera out and tell him if the dog scratches the car he's paying for a new paint job. But if he's got the time I got the lawyer!!!

Exclamation Re: Officer nails guy for speeding costs him 1mill dollars

Actually you are wrong. If they call the dog and it catch's a smell of what it perceives as "Drugs" Then the officer has "Probable cause" to beleive there are drugs in the vehicle. Which gives him a "Right" to search your car. Also, he could just simply find a stupid reason to "Detain you" Then search your car as it is standard practice to do so on impound. Then not only are you in "Jail" Your car is impounded too! Then you have to get a lawyer to get your butt out of jail, and to top it off pay to get your hot ride out of impound.

I've had all these things happen to me before. This is why I know about the second. I luckily didn't end up in "Jail." The officer chose to through this in my face after all I said was, "No, i don't want to consent to a search." I then stated my reasons for why not, "that I had, had an officer trash my ride before, and that I simply wasn't going to allow that behavior yet again." He became outraged, and threatened to detain me for some reason in which he didn't state to begin with. Over me shooting Lidar. So it doesn't matter how you say it, they are going to become a "Hostile Individual, become suspicious." And even if you "Don't have anything if that dog barks they have the right to search due to probable cause." How easy is it for them to lie about this, or that they smelt what they thought where drugs in the car? I've seen and heard this happen.

For instance Maxima lover from St Louis Missouri yes he may have got the Leo fired, although that was after he almost went to jail for as the officer said, "Some reason he could come up with."

I've found the hard way, that it feels great to deny a search, although if the officer then gets hostile, it's not worth my time. As he's just going to do anything he can to make my life miserable, and I have better things to do rather than spend a night in jail for some reason he comes up with, or for shooting my laser gun. So I'm not saying don't deny it, I do all the time. I'm just saying, they can search your car without your authority. It's called probable cause/reasonable suspition/ or better yet "Plain veiw laws." If they can see the stash on the seat and they think it's drugs they can also search.

This is where people neglect to remember, as Maxima lover stated, "Yes this is a public road, I can tape you because Privacy isn't to be expected." He may not have said this exactly but he is right. Although in his traffic stop he stated, "I have the right to privacy." No you don't have the right to privacy, you don't have any right to privacy out in "Public." That is what he neglected to realize. Although, he does have a fifth amendment right, which means he doesn't have to Tell the officer anything! Meaning legally you could even leave your window up and make the jerk speak through the glass if you wanted to. Is this recommended? NO! Although you don't have to say a word at anytime that "IS" your right. You don't have to answer any questions, or consent to any search. Although, if probable cause is determined weather or not you want to "Allow" the search does not matter anymore.

As once again You are in "Public."

If it was a house yes they couldn't enter without a warrent in hand, although in a car "Everything" changes.

You don't have to speak though, not during the stop, not during court, and not in jail. That is "YOUR" right. You don't have to say a word. Although if you don't say a word, your chances of getting detained increase if you choose to give the officer silence, as they take this as "Disrespect." Not that I personally care. Although, that is how it works. If you say "Nothing." The chances of being detained and going to jail increase, so it's a "Win, loose" situation unfortunatly...

I like the guy's response about painting his car "if" the dog scratches his car. Funny, I never thought of that. Thx man.
