I don't understand this new bill, 40 over is already a misdemeanor in IL. its just that most can get it plead down to a lesser charge.

will this new law make it not possible to get a plea bargain? other than that I don't see the point of it.

Towards the end of that article, it states that supervision is NOT an option for the judge and possibly a class A midemeanor for 40 over.
Thats the only difference i can see.

ok I reread it. the senate bill would make it a misdemeanor for 30 over not just 40 over.

and the house bill would take away the supervision option from the judge. but it does not say anything about being able to plea down to a lesser charge.

The fact of it is is that if this law had been in effect instead of the driver being given court supervision 3 months before the accident happened my sister and 3 other great kids would still be alive today.

I disagree with her. there is no way to say that the driver would have driven any differently. if so we wouldn't see drunks with multiple DUI's the get far greater punishment then speeders do and some of them go right back out and drive drunk over and over.

when will these people realize it is not the general public's fault for what a few people do? why do they feel the need to go on a crusade to push these laws on the masses because they failed as parents?

the state police's report:

According to Price's testimony, the pickup truck carrying six passengers was traveling westbound in the eastbound lane when it crested the hill at an estimated speed of 78-88 mph. The vehicle went out of control prior to impact, sliding driver's side first off the road. The driver's side of the truck struck two large trees on the north side of road. None of the occupants in the vehicle were wearing seat belts.

two things:

1) they were traveling on the wrong side of the road going up a hill. why? racing another car? passing another car?

2) no one was wearing a seat belt, hmmm my guess is they might have survived if they had.

speed was no the cause of the accident and the speed was not the cause of death. the accident was caused by driver error on a country road and they died from blunt head trauma from not wearing their seat belts.

yet they want to impose these laws to all who drive on the under posted interstates because of ONE driver who lost control of his truck while driving recklessly on the wrong side of a country road at night.
