    after listening to the recording in my opinion I think that it did sound like Bret was being a little rude and almost immediately it sounded like he had an attitude in his voice right from the beginning, however the officer I don't think handled the situation very professionally, just my two cents, I don't know why the officer felt the need to take the phone away though

    I listened to the audio and heard nothing that should have caused a problem. I don't know anyone that's happy when they are stopped by the police.

    To me it seemed the officer was trying to start something from the beginning, he got his wish. Maybe a little trip to civil court and a few thousand $ from his bank account will change the way he deals with the public.

    The officer way crossed the line when he reached in and stole the phone, yes stole it. He had no right to it, no reason to reach into the vehicle. It could be reasoned he stole the car and kidnapped his girlfriend when he took the keys and moved the car without permission.

    I would be filing charges if it had happened to me.

    Well first off. Brett got out of the car and locked the door. The officer got his keys and "unlocked the car" Then "Got in" Then "Searched". He had no permission and no reasonable cause. If anyone should be bothered by this it should be the police and the departments in the area.

    I agree that the cop went over the line BIG TIME, but I just think that maybe if Brett would have been a little bit more compliant with answering questions and just being a little but more respectful from the beginning, maybe it never would have come down to the LEO being such an a$$

    I don't see how Brett could have been anymore compliant. The officer asked if he had been drinking he answered no, he asked again he said no. Then the officer goes into his mood. What does the officer need to know why he was in a bad mood, who said he was in a bad mood, how can the officer make this determination from someone he has never met by his answering two questions with one single word.

    After that point the officer should have said he didn't believe him and suspected he had been drinking or sent him on his way. He's not obligated to look at the officer, talk to the officer, or even like the officer.

    The officer blew it, escalated it, over reached his authority and committed a crime or three!!!

    ok maybe i was wrong in saying he wasn't compliant, what more of what i meant to say is it just the attitude he was giving off sounded a little rude, maybe it was just the way the recording sounded but if just didn't sound like he was showing any respect to the officer, whether the officer deserves respect or not, the thing i always hear around at this forum is show respect and things will go easier
