so does this mean the supreme court's decision has been over turned?
It seems some government cronies are simply going to pass a bill to "void" the decision by the Ohio Supreme Court if you will via some new legislation it seems.
*Essentially* The only people who can "overturn" the finding of the Ohio Supreme Court would be a higher court... not sure if Ohio has one, but if not it would go to a Federal Court.
Lastly I have no idea how this is such a huge freaking deal, man so many people in Ohio must be jokers when it comes to dealing with speedtraps if they can't handle visual estimation as a method to overcome...
Going to federal court would only apply if the decision by the Ohio Supreme Court raised a federal question, generally related to a constitutional issue. Otherwise, the federal courts would have no standing to hear the case.
They need to require verification from a calibrated and proven device or stop wasting money on said devices.
If a LEO's "estimate" is all that's needed for a specific speed violation, (an actual MPH, as apposed to "too fast for conditions" etc) then every radar,and lidar gun is a waste of tax money. Heck painting white lines on the road and buying stop watches would be a waste too. (VASCAR)
