Texas Motorists Paying $11 Million Extra in Surcharges

New moving violation surcharges due to recent Texas legislation are bringing in millions of dollars of revenue at the expense of Texas drivers.
Houston, TX (PRWEB) April 12, 2006 -- The next time you get a traffic ticket or speeding ticket, prepare to feel more pain in your pocketbook. Due to recently passed legislation, Texas drivers must now add driver’s license surcharge fees to the lengthy list of added costs when a moving violation is placed on their Texas driving record.
Steven Owsley, a Houston-based traffic lawyer, says that the price of getting a ticket and points on your license could be very steep indeed. “Depending on what kind of infraction is issued, you could be looking at additional charges of up to $6,000 over three years from a single citation. Add that to higher insurance rates, the fine and driver’s safety course fees, and you end up with a very expensive situation.”
For the first violation, a Texas motorist will have to pay a $100 annual surcharge on their driver’s license for the next three years. Each additional point they receive will add an additional $25 annual surcharge for three years. Texas motorists driving with an expired license will automatically receive a $100 annual surcharge for three years, while those stopped without insurance will receive a $250 annual surcharge for three years. If they are stopped without insurance again, their license can and probably will be suspended.
Texas drivers who receive DWIs get the highest surcharges. The surcharge for the first DWI is $1000 a year for the next three years. If the breathalyzer test shows the driver to have a blood alcohol content (BAC) of .15 or above, that surcharge rises dramatically to $2000 a year for the next three years, for a total of $6000.
Owsley believes that the surcharges created by these laws are unnecessarily high and can cost wrongly accused drivers hundreds, if not thousands, of dollars. “Hundreds of innocent motorists receive unjust tickets every year in Texas. These new surcharges make the experience even more unpleasant and costly. My firm is ready to represent Texas motorists in traffic court statewide to fight these tickets and get them dismissed.”
Since these laws were passed, over $11 million in surcharge fees – considered by many to be unfair taxes - have been collected from Texas drivers.
