Pacing: The cop keeps the pace with you in his patrol car to determine if you are speeding. Yes, they can write tickets based in pacing.
Are tickets easy to get out of when they pace you? There is a city close to me that uses everything but VASCAR and X band. Pace, laser, K, KA, so I'm curious.
If you fought a ticket asking for records of calibration of the officers speedometer would that work?

easy to get out of... depends on if they have the records for calibration, and yes to calibration being required... in fact i beleive missouri has some case law (check tipmra website) that states calibration of the speed measuring device is requiredOriginally Posted by StlouisX50
Not so easy if the officer does it right. No set distance that pace needs to be but the longer the better. Also, no set distance the officer needs to be behind or in front of the vehicle being paced but less than 1/4 mile is best. There are cases in areas of wide open spaces where you can see forever that paces have occured at 3/4 -1 mile away.Originally Posted by StlouisX50

Another tip to add to ThestampCollectors input is to ask the officer if he noticed his speedo malfunctioning at all, and when he says "NO" ask if he is certified in speedometer diagnosis and repair, he again will say "NO", so if he is not certified in speedo repair, How can he say (to a legal degree of certainty) that the speedometer was in fact in perfect working condition at the time he had paced you. He can't!!
If the officer was not right on your bumper, (lets say he was several hundred yards back) there is an angle to show that he was actually traveling faster than you and therefore thought your speed was faster.
The prosecutions evidence is weak at best. But, this also depends on what you had admitted to him during the stop. and what type of lies he will use in court. Subponea the officers notes, calibration and repair records for the vehicles speedometer. Any tire replacements, transmission repairs, Basically the entire service history for that vehicle, and the non-factory electronics installed in that vehicle, and who installed them!!
Also, you might want to subponea any vision related items with that officer, did he wear glasses or contacts? Does he have a depth perception problem that can be shown with vision testing records?
One other "catch-all" is to research through your states DMV to find the most recent "traffic engineering survey" for the section of road that you were alegedly exceeding the posted speed limit on, you need to find when this survey was completed, and the 85th percentile speed determined. if the speed limit is lower than the survey results, the limit is illegaly posted and therefore an invented numeric ( no scientific basis ) which makes it unenforcable according to our federal laws. This is going to be a toughy without actually having the MUTCD in court (Manual of Uniform Traffic Control Devices) Part 23 is the chapter of interest.
I would re-post this thread in the "ticket-Defense" section f this forum since it has nothing to do with a radar detector.
Now, if this is for some obnoxious speed, or you were doing this in a dangerous manner, forget everything I said, you deserve the ticket!!!
But if it is for a couple MPH over in light to no traffic, give it a shot.
I could also suggest spending the money on the "TIPMRA" if you are comfortable in court and willing to do your research and present it properly.
If you truly deserved the ticket; Talk with the prosecution and ask for a reduction.
cops around here pace more then anything else
Here's what I dont get. Let's say that they do pace. There is no way that they can say that you were going EXACTLY a certain speed. In other words, if you were going 15 over, well that is reckless in VA. You could argue that you were going 13 over and avoid a more serious ticket. The cop can't keep EXACT distance from you.
why doesnt the cop just get behind u and instant on u...i could swear that if u are driving and a cop is behind u he can get ur speed
Not all LEOs have radar/laser. Most of my local LEOs don't have either.
