    Default Let's clear something up: VA radar detector laws

    I've heard a lot of misinformation running around these forums that driving around in Virginia with anything but an STI is "a very expensive game." The implication made is that you automatically lose your radar detector if you are caught with it. Not true! Here's the law:

Any such device or mechanism may be taken by the arresting officer if needed as evidence, and, when no longer needed, shall be returned to the person charged with a violation of this section, or at that person's request, and his expense, mailed to an address specified by him. Any unclaimed devices may be destroyed on court order after six months have elapsed from the final date for filing an appeal.

    Except as provided in subsection B of this section, the presence of any such prohibited device or mechanism in or on a motor vehicle on the highways of the Commonwealth shall constitute prima facie evidence of the violation of this section. The Commonwealth need not prove that the device or mechanism in question was in an operative condition or being operated.

    B. A person shall not be guilty of a violation of this section when the device or mechanism in question, at the time of the alleged offense, had no power source and was not readily accessible for use by the driver or any passenger in the vehicle.

    C. This section shall not apply to motor vehicles owned by the Commonwealth or any political subdivision thereof and used by law-enforcement officers in their official duties, nor to the sale of any such device or mechanism to law-enforcement agencies for use in their official duties.

    D. No demerit points shall be awarded by the Commissioner for violations of this section. Any demerit points awarded by the Commissioner prior to July 1, 1992, for any violation of this section shall be rescinded and the driving record of any person awarded demerit points for a violation of this section shall be amended to reflect such rescission.

    So you get a fine and you keep your RD. Worst case scenario, they take it away to use as evidence and you get it back later.

    All the officer needs is the serial number off your RD.

    Thats good information. I myself had thought that if it was confiscated it was HARD to get it back, and that its the officers discretion to confiscate or not. I was not aware that you can get it back by simple request. Very good info, thanks!

    I think a lot of people get confused with what occurs in Canadian provinces with Radar Detector restrictions where they WILL confiscate it.

    Yeah, I think people are thinking Canada when they think virginia.

    I don't think people are so worried about the RD being confiscated as much as they are about maybe getting a "guaranteed" ticket for speeding since they have a RD to "beat the system" to begin with. RDs are illegal in VA and you can be fined for having one. Being pulled over in VA with a RD may mean you are getting a ticket when maybe the cop would have let you go had you been speeding without the RD.

    But you can also be pulled over FOR just the detector as well, even if you arent speeding.

    Overall, I would stick with a Bel STi Driver only if I lived in VA. Just so I don't take any risks. Better safe than sorry. :wink:
