SEMA 2007
Just got back home after being at SEMA 2007 in Las Vegas.
Over the next couple days I'll be posting a few new products that I saw at the show along with new product announcements that I'm expecting at CES in January.
I've just completed my first post about RMR's pending lawsuit against the FCC on the blog

I'd be interested in your comments and if anyone has access to obtaining the court filing in El PasoStates that I have flown my C-182T to:

Yay PACER!
Reading through the complaint is kind of funny, given the bit of background I've picked up on the forums/the web in general regarding RMR and their activities.
The complaint looks to be fairly standard for a start, without looking over it in great detail. RMR's chances of getting the injunction they're asking for *on a PRELIMINARY, TEMPORARY basis* might not be as slim as one might assume, largely because they seem to be basically being put out of business by this ongoing brouhaha. Preserving the status quo during consideration of the case can sometimes be a good thing.
I thought it was interesting that they have a small, 5-attorney firm representing them in this action, and that includes two (presumably) junior associates who were admitted in 2004 and 2006.
That may be all they can afford right now, but you'd think you'd pull out all the stops for a lawsuit against a federal agency that's likely to determine whether the company has a future or not... (short of producing products that don't run afoul of the FCC and allegedly not work, which seems unlikely!)
Also, re jury trial: that's a standard boilerplate that you'll find at the bottom of almost any civil complaint over almost anything. Doesn't mean it'll amount to anything... especially when there are serious questions re: matters of law. But we have the 7th Amendment for a reason...
In any event, interested in how this one plays out!

The RMR losers didn't even get an attorney who can defend the case in Texas. The lawyer signed "Pro Hac Vice" which means that he/she isn't allowed to argue cases in Texas, but must first apply to the Court there to get permission "for this one time."

I'm assuming these guys are the "usual" attorneys for RMR, and that explains their using them? I really, really, really can't think of any other good reasons for it... If that's the case, then the pro hac vice isn't all THAT unusual. But still, that firm is almost certainly going to be hopelessly outmanned and in for a world of hurt once proceedings start. I'm really not sure that they 100% understand what they're getting into, either RMR or the small firm.
