I don't think they are illegal. Not in Texas anyway. We have moved on to a digital setup that is encoded so unless you have a handitalkie with the same frequencies I don't thing you can listen in.
I'm not saying it's not possible just a little more expensive.

Yeah, you're looking at a minimum $500 dollar investment for a scanner to listen to Austin-Travis County these days. Luckily, I have five of them in my car.

They are illegal if they are they installed in your vehicle here in Florida. You can have them in your home, though.
I remember there was something about as long as you had it on battery power (cuz it was not technically "installed/hardwired" into your car) you were OK, but they may have changed that. I think if you have a HAM license you can have them installed.
Either way, now you have to figure out what you area uses. Digital or analog. FHP has digital encrypted, as does Winter Springs (little, rich town around here.) Orange County I think has half and half, analog/digital. If you have an analog only scanner, you won't be able to hear digital.
