View Full Version : Is it LEGAL to use a RD for Simple Delievery Job?

Hi folks.

I'm sure we all know how great the economy currently is (*cough*). It seems I'm getting paid less working in my chosen trained field of electronics circuit boards than I could be making delivering PIZZA! WTF?? I just don't get it, all of that training and nobody wants to pay sqatt for what has always been considered a skilled trade. I now learn that some fast food places are paying much better and with good health insurance than what I THOUGHT was a good factory job (yeah right..). In fact, there are not too many jobs here period, so most of the jobs for the really big factories actually pay very little while now the little fast food places are starting to pay more and offer more benefits-- Man this is sooo bass-ackwards!

First a little background: I have a brand new small 2009 econo-box that is completely paid for due to a car insurance settlement for the ONLY single accident I ever had, and it was due to my brakes failing around a curve. I was not cited with anything nor blamed for the wreck, and nobody else was involved, just me flipping my 4X4 over and over on the road about 6 times!! - Thank GOD for SEAT-BELTS, and THANK GOD PERIOD!!! I walked away with only a scratch or two..... I was dizzy for a few days however, and I was angry with the car company because I had complained about my "ABS Brake Fault" alert going off/on and the dealership could NOT fix my problem and left it in a state that almost got me killed!! NEXT my car insurance was very nice to me, as my record was perfectly clean to this point, and they paid me a little more than I could of outright sold my truck for.... Thus....

I now have a 2009 car fitted with all of the electronics I like when I drive, and this is the most fun to drive car I ever had. 37 MPG is like a dream to a guy that was getting under 18 in a mid size 4x4! So basically my question is this:

By strict definition of Federal law (USA) is it not legal to use a radar detector while delivering PIZZA?? I know it's not legal for commercial drivers like Semi Truck Drivers to use RD's, and I have seen a few taxi cabs use Rds, and yes I have seen my share of RD's in the local pizza delivery cars too- BUT, is it LEGAL for one to do this? I get the feeling it may be technically not legal, but perhaps the leos often overlook these things because they realize such drivers are always in a mad rush just doing their jobs. - For example I have a relative that drive for FedEx for many years- In all that time he never got a speeding ticket, yet he admits doing mega speeding and even speeding right past the police and not once was he pulled over. Even he was surprised and he advised he never heard of a FedEx driver ever getting a speeding ticket. So, I have to wonder how the locals and state boys might view a small car with a pizza sign on top, and a radar detector discreetly mounted...??

Opinions?

I don't think it really matters if you're delivering pizza or driving dressed up as a clown, you can still use an RD.

It would be against the Law in Virginia, Washington DC , and on military bases and thats the only places I can think of.

The law states:

TITLE 49--TRANSPORTATION

CHAPTER III--FEDERAL MOTOR CARRIER SAFETY ADMINISTRATION,

DEPARTMENT OF TRANSPORTATION

PART 392_DRIVING OF COMMERCIAL MOTOR VEHICLES--Table of Contents

Subpart G_Prohibited Practices

Sec. 392.71 Radar detectors; use and/or possession.

(a) No driver shall use a radar detector in a commercial motor

vehicle, or operate a commercial motor vehicle that is equipped with or

contains any radar detector.

(b) No motor carrier shall require or permit a driver to violate

paragraph (a) of this section.

[58 FR 67375, Dec. 21, 1993]

My non-lawyer advice is that you are not a commercial vehicle. You don't have a DOT # on your vehicle, it is licensed and insured to a private individual.

x2, unless you landed a job like me delivering Pizzas in Killeen where I was required to drive on base it doesn't matter. Commercial Motor Vehicle does not include a passenger vehicle used for delivery, if the vehicle doesn't require a CDL you're in the clear unless you'll be delivering pizzas to VA, DC or military bases.

49 USC 31301 Definitions;

(4) “commercial motor vehicle” means a motor vehicle used in commerce to transport passengers or property that— (A) has a gross vehicle weight rating or gross vehicle weight of at least 26,001 pounds, whichever is greater, or a lesser gross vehicle weight rating or gross vehicle weight the Secretary of Transportation prescribes by regulation, but not less than a gross vehicle weight rating of 10,001 pounds;

I probably wouldn't be able to get in with my Sig in the glovebox anyhow. I cannot drive to the "secure" area of seaports either...

I think it's only commercial vehicles over a certain gross weight that qualify for the "RD ban".

But then, the RD ban is a bad law anyway... if you drive a truck, get an STi or Redline and call it a day. ;)

As per my DL (Ontario, but it's similar anywhere in Canada and USA): G class: any MV up to 11,000 kg (24,250 lbs), everything above that weight becomes a truck-like commercial MV and will go under the RD ban in USA.

I doubt it's all that common, but I've been told that full-time pizza delivery guys working at a good, busy pizza place, can pull down > $50k in a year once you factor in tips.

I don't know all the details - whether these guys were driving their own cars, if mileage was reimbursed, etc., but that's the story. I tend to believe it because the guys I heard it from used to deliver and now run a successful local pizza chain. They have no reason to BS about it.

It's all BS, this factor is based on if every delivery you made pulled in the highest tip amount that you could expect (i.e. a $10-15 tip.. most people tip $1-2 if at all.) Yes mileage is reimbursed in a share of the delivery fee for each pizza you deliver (i.e. if it's $2 delivery fee you can expect to see 75 cents of that, another reason people aren't tipping, the delivery fee goes to the driver, and the tip is for gas -- not service -- which you're already being reimbursed for.)

It's all BS

I dunno, they weren't trying to recruit people (at least not directly), it came up at a talk they were giving to a group of businesspeople. It seems really high, but it comes out to $24 / hour (using 2080 annual work hours) which could maybe be doable? Like you said, it's getting the max tip on pretty much every za you deliver, and a damn busy delivery shop. But maybe a cat could pull it off?

Last time I ordered from them the guy brought my pie in a Mini Cooper S, which he'd taken the passenger seat out of so he could fit more pizzas in, which attests to the volume.

Maybe part of me just thinks the idea of a pizza guy pulling down $50k is cool, and I want to believe...

Dont most pizza drivers work part time. Like 5pm to 10 pm and later on the weekends. Maybe 25-30 hrs a week?

Exactly. They don't like giving you fulltime hours because then it runs into possible overtime needing to be paid, they give you 4 hour shifts and let you work up to an extra 4 if you volunteer that and it's a busy day, but shop owners do NOT like to pay their drivers. You're looking at minimum wage to maybe $2 above min wage + delivery cost sharing + tips. You can make about $12-15/hr on tips, but the wear and tear on your car is not worth it. I work from home with my wife making $43k/year and only use the car to go shopping now -- I'd much rather do that then try to make $50k in the za business if it was even possible:D

I'm not a restaurant delivery driver but I work with to them. For us, there is one or two drivers in the afternoon who usually stays all day and night. At night more come in for the rush. I can tell you that most of them do make minimum wage + tips. I've seen tips as low as a pencil and some as high as $100. Most of the time it is between $3-$5. A lot of them talk about how they feel bad for their car because it is constantly on and off all day plus all the miles. I can guarantee you no driver makes 50k a year.

Thanks for all the information gang, you have been a real big help. Actually being able to read the exact law at issue helped me a lot, because I was confused as to what a commercial vehicular was defined as, and google just had me even more lost.

I know it may seem like I should be earning a decent living given what I do, but may I remind the kind members here that electronics production is 99% dominated by China. Everyday there are fewer and fewer jobs here that even remotely have to do with what I was trained and have years of experience doing. I'm good at troubleshooting and production of all types of electronics, but I'm not an Engineer and the American companies are constantly trying to dumb down these types of jobs so unskilled people working for mim wage can do it- OR they simply order take out parts from China- In other words, jobs like I do, and have done, are quickly moving to China and I see no stopping it unless Americans suddenly start caring about what country makes their computers and stereos etc (and I can not recall the last time I seen another customer actually check what country a product was made in- it really matters to people that are in my shoes).

So, I'm not exactly getting rich in my career, and it's true I used to make more money when I was much younger. I could easily be doing better if those pizza drivers are making 1/2 of what has been speculated here! Man it sucks for me.

If I could get a FULL TIME job doing it I am almost ready to ask some of the nearby locations about it. I even have a GPS that just might come in very handy at finding addresses I don't recognize- IF I don't get robbed, but the local city is very low crime.

Here is the car I would be driving:

Sorry, I get carried away with my little car. lol - If I got paid enough I dont think I would mind putting a lot of miles on my car doing the pizza thing. Otherwise I'm likely to drive at least 100 miles round trip going to work and back- because I'm in the mountains here and the city near me is very small. Most jobs are about 50 miles or further away. And the economy still makes it tough finding work no matter how far I drive nor where I may move.

Thanks again for all of the feedback, it's been a real big help!:)

With all do respect but what you got in there is freaking UGLY!!!

I got in my car the following: Garmin GPS, handheld CB Radio, XM sat radio, STI, in-car camcorder and my own two-way radio (Motorola i730) to get in touch with my company (no long distance and no roaming anywhere in US and Canada) AND I got NO wires and cables running around in front of me!!!

STI and XM are both hardwired, Garmin GPS is on the dash right above one of the mid-vents so the power cord is coming down the dashboard, XM is mounted INTO the left mid-vent where your air freshener is, the handheld CB is btwn the front seats, what else, the camcorder is on the passenger headrest and the power cord is behind the seat, I also run a multi extension cord and a 75W inverter for the camcorder so, all neat and clean, personally I really hate having damn cable running ugly in front of me! Not just for me, my taste and to have clear view of the road ahead (I got NOTHING in the windshield, the STI is by the sun visor) but I like people to admire my car and when they see dozens of cables hanging around the windshield, well... it's UGLY!!!!

Make sure you check your state's laws regarding this as well. I'm too lazy to dig up the exact paragraph, but Illinois State Law seems to define a commercial vehicle as any vehicle used to transport goods for commercial purposes. I used to deliver pizzas for a couple months and after looking up the laws I came to the conclusion that it was indeed illegal, but it's only a $60 ticket here and you get to keep your detector. Also had a cop see it and not say anything, so they might be ignorant to the law (or assume it applies only to truckers).

For what it's worth, I made about $90-110 in a typical 7 hour shift delivering pizzas on the weekend. This was in the near suburbs of Chicago.

Chris, with all due respect, I do agree that most people would find the dashboard cluttered with wires. However I'm an electronics major and what I see is more like Heaven, and frankly I'm proud of it. I'm not in a contest with the coolest install guy, all I care is that the gadgets get their power they need, and without a serious hazard such as a wire over an air bag. I know these things can be all hard-wire and the cables mostly hidden, and I might get around to doing that some day. But if I ever have somebody in my car that says anything about it (unless there making a joke about it) then I'm going be calling such person stuck up. lol If it aint broke, why fix it. It all works fine and I did not need 10 hours to simply get battery power to items.

Yes I had the Grant XL back in the day, now I'm running some crappy Cobra ULTRA 19 III or something, exact model in my sig. Works fine for short communication but I loved the Uniden

And like I said before, certain individuals such as myself don't "CARE" if it's illegal in a big truck. I will drive a semi truck right over that stupid fu*&^n law. Basterds! Sorry, I had to vent. Jammer, as an electronics enthusiast, I know how you feel. You have it set up the way you like and that's what matters. Keep up the good work.:)
