Reckless Driving Rule Still the Same After Speed Increase

Lynchburg, VA - On some sections of Virginia interstate, the speed limit is now 70 miles per hour, but you don't want to go much faster than that.
Statewide, if you're caught going 80, you won't get a speeding ticket, you'll be charged with reckless driving!
A lot of people think it's time for that to change. And state legislators say they will introduce legislation to change reckless driving to 20 miles per hour over the speed limit.
"It's not the actual amount of speed. It's that you are so much exceeding what's deemed to be safe for that particular section of the roadway. That's what we then decide is reckless driving," said Delegate Scott Garrett.
Legislators point out officers have a certain amount of discretion when writing a ticket.
^^I laughed when I read this, bs Hellginia cops write you for what they clocked you at if you go over 80 or 20 over the PSL.
Hellginia people might finally be starting to wake up. I still show much hate for the state, but 90 is much better then 80 reckless driving. If this passes North Carolina is the worst state on speeding penalties next to Hellginia.

I thought the laws in NC only sucked if you had a NC drivers license. They will suspend your license for 30 for anything over 80. But if your out of state I don't think your license gets suspended.

NC is not not so bad a good lawyer and you can get out of anything. my brother lives there and he has beaten a lot.
and I believe your right about it only being a problem for NC residents. if you're out of state I don't think they suspend you. but I can say the VA will suspend in state and out of state drivers.

one more thing. I really hate these reckless driving laws that only use speed as a factor. Speeding should not be the only reason for issuing RD. there should be a real reason for issuing RD there should be a requirement of at least two major violations to be able to charge someone with RD. (for example weaving in and out of traffic and speeding or tailgating and speeding or you get the idea)

Agree fully ....but leos would reply ...it is so complicated ...much easier to do laser/radar ...easy going.

When I was on 4h grade we had a test where we had to name the 50 states. Later in the day the teacher (female) calls me up to her desk and asks me, "how do you spell Virginia.". I reply, "V I R G I N A" again she asks me how do I spell it (this time sounding a bit annoyed) and asking me if I was missing a letter in the name and say, "no, V I R G I N A" This went on a few more times each time her noticeably getting mad at me, then finally she pulls down the map and says "look there, now how do you spell Virginia. That day I learned how to spell Virginia, but I much prefer Virgina!

Nope. When I got a ticket from a silly NC state trooper for 85 in a 65 he informed me that it was reckless driving and a mandatory court date, and if convicted I would lose my driving privilege for 30 days in NC.
I went to court without a lawyer after pushing back my court date and the dumb trooper didn't show. I was found not guilty.
So yes, they do suspend your license even with an out of state DL. A girl I went to school with down there got a ticket for 81 in a 70. She plead guilty with no lawyer and they suspended her Maryland DL for 30 days in NC. MD did not record the action on her driving record and she still had a Valid MD license everywhere except NC.

Nope NC and VA have the worst drivers licenses in the nation. If you receive a ticket for speeding in California and it would be considered reckless in NC (like going 15 over or above 80), they will suspend your NC drivers license. Same with VA and their statues.
My MD license does not access any points for out of state violations, unless you commit a felony with your vehicle or a serious DUI conviction.

Yep...that's what's unofficially done around here - two or more (it's usually actually three or more so there's more proof/cause) offenses that factor into one stop. Reckless driving is considered a "serious" offense in Pennsylvania, one of only seven offenses that can claim that title, and it's probably considered a serious offense across most states. Thus it should be treated that way.
Using a "x-over" limitation for reckless driving makes more sense than a blanket speed that no one can go over. Especially when a PSL of 70mph only gives a cushion of 10 over.

I also got a ticket for 15 over in NC with an out of state lic and did not have to go to court or get my lic suspended in NC.

Damn that's interesting, how long ago did you have an NC license? My tickets were recent, got popped in 2009 in NC. Same with the girl who had her out of state MD license suspended in MD.
Another story would be my friend from Raleigh NC got his license suspended twice. Plead guilty to 22 over in NC and got a 30 day suspension, and got a ticket in SC for 21 over this past April, SC notified NC and his license was suspended for 30 days. It's been made pretty clear that NC does not play around with speeding laws. Same with Hellginia.
Then again, my dad got a speeding ticket for 78 in a 55 in Massachusetts in 2005, he never paid it and nothing happened to his license. I'm not sure if the states only report major offenses you don't respond to or what. Sometimes I honestly think it's luck with the DLC and all those other pacts states make...
