If you were speeding and a cop was behind you, passed you, in front of you, etc but did not have a radar gun on him and wasnt clocking your speed, can he still give you a ticket?

Yes he is still able to give you a ticket based on the measurement on hish speedodometer. In fact a few weeks ago a car was folling a state trooper going about 75-76mph and the cop moved over let the guy pass and then lit him up. Not once used his radar.

yes. but will it stand up in court without any other evidence but his eyes . . . unless you live in Hazzard County,probably not.

sure but it wouldn't be hard to fight w/ a well put together defense.

Yes police can get you for what is called pacing if they are driving behind you. What they do is drive behind you they are supposed to keep the same distance between their car and yours. If they do this then whatever speed they are traveling is also your speedl. States like CT use this alot. Also police can always visualy estimate speeds. Theya re trained to do so. For this reason you can always get busted for speeding if you are stupid about it no matter how many toys you have.

Some states train their Highway Patrol folks in visual speed estimation.
There's a page on the FHP's site that shows cadets estimating speeds, and an instructor using a lidar gun to verify the cars speeds, and record the results.

In college I was paced one night by a Harris County Sherrif Deputy from the feeder. I was in the left lane on the freeway, he held back a couple of car lengths and paced me for about half a mile (he claimed). It held up in court and I had to pay.

isn't that wrong though if you are speeding and a cop is in front of you speeding too and he pulls u over. i no around here they don't do that, ive been following a cop before in town speeding and he was in front of me i was going like 35 in 25 and didn't pull me over. same with the highway patrol 80 in 75, but i suppose that isn't to bad for the the interstate. fast as i no if a cop isnt speeding and he doesn't have his lights on you can follow speeding.

Truth of the matter is a cop can ticket you under any circumstance, but as others said, it's the issue of weather or not you're going to pay it like an idiot or fight it in court.

Slick tops are one thing but fully unmarked traffic cops are BS especially at night. Oh and BS spells BULL SH!T! In case you didn't know. There are plenty of idiots out there to prey on. Why the disquise?

I am training my daughter not to stop for ANY unmarked LEOs. She will drive the PSL, call 911 and drive to the nearest PD or Hospital before she stops for that BS. Fortunately in TX that you are allowed to do that with unmarked LEOs.

I have no patience for that sh** at all.

i got pulled over by an unmarked after renewing my liscence on my 17th b-day a few blocks from the DPS office. I wasnt going to stop and continued toward the police department, then just ending pulling over after he tried pulling beside me. For being so ticked off that i wasnt pulling over i was supprised it was just a warning. Ended up being a bad tail light and gave me a birthday warning. he told me if it wasnt my b-day and i would have pulled the "same $hit", i would have gone to jail for evading police, he was just being a complete a$$hole.. how nice. man what an a$$.

So how do I find out if that is the case here in Florida?

Let me give you a LEO's perspective. First as far as getting cited, well yes they can its all about what the LEO's observations were. Remember he she has to be able to articulate in a court of law why you were in violation. The method that the LEO uses whether radar or something else has to meet the standards of the courts. Most LEO's are quite knowledgeable about what information they need for a conviction & are generally pretty good at presenting in it court (remember they get a lot of practice). You might run into a less expereinced LEO & maybe you can beat it. I can only speak for my jurisdiction, even if you get a dismisal you still have to pay court costs. If you lose you pay court costs plus the fine, so you have to be really sure if its worth it. If your lucky the LEO will have to be some where else & you will get it dismissed.

As for not pulling over for what we would call a "concealed code-3 unit" (unmarked) I too have daughters & a wife that I worry about. At the very least stop where there is alot of lighting/people etc. If you just do not stop what may happen is that then the unmarked call will call for assistance & marked units will then begin to pursue you. Depending on your actions at that point you may be taken from your car at gun point & handcuffed. So when you give advice to anyone about this do so with caution. Hope this helps drive safe 8)

I believe I read in the paper around here (Chicagoland), if motorists don't want to pull over, they should put on their 4-way flashers and head to an area where they feel safe (i.e. busy gas station, police station, etc.).
