It depends if you are weaveing in and out of traffic and are actually being reckless I think. If theres nobody around and your doing 85 they usually bring it down to just speeding here.

"§ 46.2-862. Exceeding speed limit.

A person shall be guilty of reckless driving who drives a motor vehicle on the highways in the Commonwealth (i) at a speed of twenty miles per hour or more in excess of the applicable maximum speed limit or (ii) in excess of eighty miles per hour regardless of the applicable maximum speed limit.

This law means you can get a reckless driving ticket for doing 81mph in a 65mph speed limit zone in Virginia. Reckless driving is a criminal offense in Virginia and a conviction of it gives you a criminal record. Reckless driving is a class 1 misdemeanor in Virginia. A class 1 misdemeanor is the highest class of misdemeanor in VA. Virginia is the only state I know of that charges people with a criminal offense for exceeding the speed limit. Exceeding the speed limit in most places is a traffic infraction not a criminal offense.
