    Probably sneezing is a more significant risk. Stats for this bill say that ~1% of accidents with a contributing agent involve cigarettes.
    Will be a secondary offense, so charge may not be made unless the officer or trooper observes and tickets or arrests for another 39 offense.

    The fine for tossing a butt out is much dearer than the proposed fine for smoking while driving.

    I suspect rush-hour with PA drivers "jonesing" for a butt will be even more delightful. There's a sign in western NJ on 78 that reads "Live in PA, work in PA", so I expect we will see a crackdown emerging on PA drivers commuting eastbound through Warren and Hunterdon counties. Plausible deniability will apply in this situation, of course. After all, a sworn P.O. Or trooper's job is to enforce the law. Most PA drivers are fine, but the poor ones elicit a xenophobic response from us natives.

    Things our politicians should address in order to improve safety on highways:

    1. Road surface repair: The E/W interstates in NJ are horrible, route 78 is a stone-chip generator at this point. No windshield is safe.

    2. Replace cats-eyes--they work.

    3. Enforce laws covering containment of material, e.g. dump-trucks, garbage trucks, snow-covered 18-wheelers, etc.

    4. Inspect tires at weigh stations (or ban recaps). We have the cap-hurl du jour AM and PM during rush-hour. These cause multi-vehicle scatters, roll-overs and kill motorcyclists.

    5. Enforce excessive lane-change (dancing in street) laws.

    Technically they've already done this, take a look at new cars especially in California. They don't come installed with ash trays at all.

    Not meaning to flame anybody, but maybe cleansing/extermination humorous references should be avoided as I know a lot of people who would be deeply hurt and offended by this.

    let's all forget about that and go back the Smoking Banning in car

    In my opignon Cell Phone should be banned way before smoke (I don't smoke) but I think cell phone is way more distractive then smoking :?

    The only people you can really blame for this law passing is the citizens of New Jersey.
    If the people would have been more aware of what their politicians were doing stupid laws like this would NOT get passed.

    It all comes down to getting involved!

    It's likely to die. Apparently its sponsor is an anti-smoker as one of his parents (a smoker) died from emphysema. Of course, he's probably ignorant of the high incidence of COPD in NJ due to coal heating last century. Also he has been sponsoring smoking bans in bars. Apparently he's also ignorant of the mutation causing oral carcinomas: same genetic locus for smoking and alcohol drinking. Neurotics will seek validation and questionable resolution for their anxiety anywhere.
