The allegations about Matt Mitchell are included in an amended suit filed recently in a circuit court here on behalf of Kelly and Christine Marler, who were hurt in the crash in November 2007. Mitchell's auto crossed the median and slammed head-on into a car containing Jessica Uhl, 18, and her sister, Kelli Uhl, 13.
Mitchell has pleaded not guilty to two counts each of reckless homicide and aggravated reckless driving. The assistant attorney general assigned to represent him couldn't be reached for comment.
