    Question Can a cop take my RD?

    I may be missing it but do we have an up to date listing of which stated radar detectors are legal ir illegal? Particularly in GA...

    If i get pulled over for any other reason other than speeding, should i put my detector away?

    Can the cops take my detector?

    They can't take it away if you are in Georgia. Now if you were in Virginia or Ontario...

    I would only take your RD down if you think a LEO beat you with a I/O shot before he pulls behind you to pull you over.

    Are Radar Detectors Legal?

    In the US, Radar detectors are legal for passenger vehicles in 49 states. Radar detectors are illegal in Virginia and Washington DC. Federal Law prohibits the use of radar detectors in all commercial vehicles over 10000 pounds. Radar detector use is also illegal on military bases.

    In Canada, only Alberta, British Columbia, and Saskatchewan allow the use of radar detectors.

    Various radar detector bans exist in other countries worldwide, check your local regulations.

    My take is that they have a badge and a gun and can do just about anything they want - now whether or not what they do is legal, correct, right, or wrong or can they get away with it is another matter all together.

    Course if they arrest you they will take your vehicle and everything in it.Procedures and chances for getting your vehicle and its contents back depends on the offense, law, etc.

    Again, just my take and opinion.

    No state in the US can confiscate your radar detector. Ontario does confiscate them on the spot so that's probably the inspiration for anxiety.

    I've heard stories of VA troopers threatening to confiscate detectors but US states would require a specific law outlining the requirements for property seizure. None have done this to date. Even so, property seizure is a tricky business in a country that has such broach free market protection. Specifically protection given to banks to maintain leans on loans and properties.

    Case in Point: In 2001 a friend of mine was stopped for speeding in his 2000 BMW 330. His vehicle was searched and they found enough cocaine to seize the vehicle under DEA seizure laws. The problem started when the bank looked at my friends assets which were very little and the balance of the loan on the vehicle which was very large. The bank did not want to enforce the balance of the loan with a court order to make payments so they requested the state of Texas auction the vehicle to pay the loan balance. The state didn't want to go through that trouble, so they handed the vehicle back to the bank. The bank didn't want to sell the vehicle either and since my friend was only on probation for the drug charge and was gainfully employed they gave him the vehicle back.

    So in the end the Bank had the final say.
