the city doesn't have the authority to supersede the state vehicle code.
Local governments need to know their place, or we'd end up with a confusing patchwork of laws that could be used by
"You're in a heap a trouble, BOY" type cops to pick on out-of-towners.
If it is the conversation that is distracting then that would mean that a conversation with a person sitting right next to you or behind you should be illegal, or listening/singing with the radio should be illegal.
Singing to the radio just requires recitation of memorized lyrics and the radio doesn't care if you stop. Low mental effort and little commitment to the task is required.
Conversations with passengers in the same space comes naturally and usually your passengers don't want to die so they're OK if you ignore them to deal with some hazardous situation. Moderate mental effort and little commitment to the task.
A conversation on a cell phone requires your brain to completely switch contexts from the driving environment to visualize the presence of the other person and think about how to respond to them. And they often care more about making sure you stop at the store to get mlik or telling you about what sort of trouble Johnny got into at school than the fact that you're trying to drive. High mental effort and high commitment to the task.
I've noticed that when I'm on the phone my attention shifts more straight down the road and closer in front of my car - I just end up reacting to situations instead of being able to look ahead and predict them. That might be alright sometimes but it seems like a lot of people don't have the discipline to recognize when they're impaired and ignore the phone.
